Article 1 – Identity and Applicability

These terms of service apply to any use of the ToetsTester application.

By using the application, the user (employee of the educational institution) agrees to these terms.

Article 2 – Description of Services

2.1 Functionality

The software supports users in grading tests, both handwritten and digital. ToetsTester provides an integrated environment for efficiently assessing and providing feedback on test work.

2.2 Technology and Framework

AI Technology

The processing uses AI functionalities for reading and grading test questions. For this purpose, ToetsTester uses sub-processors.

Educational Framework

The service is exclusively intended to support teachers and staff within educational institutions.

Article 3 – User Responsibilities

3.1 Professional Review

The user is at all times fully responsible for the content of generated documents. The AI output serves as a draft and must always be validated by a qualified staff member.

Data Minimisation

The user is not permitted to process more personal data than strictly necessary for the established educational purposes.

Article 4 – Privacy and Intellectual Property

4.1 Data Protection

The Model Data Processing Agreement 4.0 of the Privacy Covenant applies to all processing. See toetstester.nl/privacy for more information.

4.2 Ownership Rights

All rights to the software remain with ToetsTester. The generated output and processed student data fall under the control and ownership of the educational institution.

Article 5 – Liability and Warranties

5.1 Limitations

Given the non-deterministic nature of AI models, ToetsTester cannot guarantee that the AI scores and feedback provided are always entirely correct. Human review is therefore mandatory.

5.2 Decision Making

ToetsTester is not liable for decisions made by the educational institution based on AI-generated texts.

Article 6 – Duration and Termination

The duration of these terms is linked to the underlying agreement between the educational institution and ToetsTester and/or the agreement between the user and ToetsTester.
